These terms and conditions outline the rules and regulations for the use of Chess Prep Pro.By using this app we assume you accept these terms and conditions. Do not continue to use Chess Prep Pro if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", "Chess Prep Pro", "Chess Prep Pro Openings", "the app", "the website", "the software" refers to our Chess Prep Pro. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Ireland. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same. 1. License

Unless otherwise stated, Chess Prep Pro and/or its licensors own the intellectual property rights for all material on Chess Prep Pro. All intellectual property rights are reserved. You may access this from Chess Prep Pro for your own personal use subjected to restrictions set in these terms and conditions

Republish material from Chess Prep Pro.Sell, rent or sub-license material from Chess Prep Pro.Reproduce, duplicate or copy material from Chess Prep Pro.Redistribute content from Chess Prep Pro.This Agreement shall begin on the date hereof.Parts of this app offer an opportunity to download pre-made chess repertoires from the app. Chess Prep Pro may not filter, edit, publish or review Comments (also known as annotations) on positions in a chess repertoire prior to their availability to be downloaded. To the extent permitted by applicable laws, Chess Prep Pro shall not be liable for the these comments (also known as annotations) or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the these comments on downloadable repertoires in the app.

3. Hyperlinking to our App

The following organizations may link to our App without prior written approval:Government agencies;Search engines;News organizations;Online directory distributors may link to our App in the same manner as they hyperlink to the Websites of other listed businesses; andSystem wide Accredited Businesses except soliciting non-profit organizations, charity shopping malls, and charity fundraising groups which may not hyperlink to our Web site.These organizations may link to our home page, to publications or to other App information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party’s site.

Commonly-known consumer and/or business information sources;dot.com community sites;associations or other groups representing charities;online directory distributors;internet portals;accounting, law and consulting firms; andeducational institutions and trade associations.We will approve link requests from these organizations if we decide that: (a) the link would not make us look unfavorably to ourselves or to our accredited businesses; (b) the organization does not have any negative records with us; (c) the benefit to us from the visibility of the hyperlink compensates the absence of Chess Prep Pro; and (d) the link is in the context of general resource information.These organizations may link to our App so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s site.If you are one of the organizations listed in paragraph 2 above and are interested in linking to our App, you must inform us by sending an e-mail to Chess Prep Pro. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our App, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

5. User Conduct and Responsibilities

Use of the Chess Prep Pro application ("App"), available on chesspreppro.com, the Google Play Store, and the Apple App Store, is subject to strict adherence to appropriate conduct by the users. Users are expressly prohibited from engaging in any activity that jeopardizes the integrity, performance, or availability of the App. This includes, but is not limited to, hacking the App’s systems, circumventing any security features or paywalls, conducting or attempting to conduct Distributed Denial of Service (DDoS) attacks, and any other form of interference that may damage, overburden, or impair our servers or network. Activities aimed at reverse engineering, extracting source code, or theft of intellectual property, as well as any attempts to exploit the App or its services for unauthorized commercial purposes, are strictly forbidden. Violation of these terms will lead to immediate termination of your account, may result in legal action against you, and you may be held liable for any damages caused to the Company or its users.

6. Monthly and Yearly Subscription Terms

Subscriptions to Chess Prep Pro, including both monthly and yearly plans, are exclusively billed through the Google Play Store or Apple App Store systems, depending on your device. Subscribers may cancel their subscription at any time through the respective store’s subscription management page. These subscriptions auto-renew unless cancelled by the user. Upon cancellation, access to premium services will be discontinued at the end of the current billing cycle, for any reason. It’s important to note that premium features are tied to your Chess Prep Pro account and are subject to the terms and conditions of the app. We reserve the right to discontinue the Chess Prep Pro application at any time, which may result in the termination of all active subscriptions. In the event of discontinuation, subscribers will be notified through the app or via email with as much notice as possible. However, we cannot guarantee the continuation of services up to the end of a billing cycle in such circumstances. By subscribing to our monthly or yearly plans, you acknowledge and agree to these terms, understanding that the availability of premium services is contingent upon the ongoing operation and maintenance of the Chess Prep Pro app as determined by Chess Prep Pro.

7. Lifetime Premium Purchase Terms

The "Lifetime" in Lifetime Premium Purchase refers to the lifespan of the Chess Prep Pro application ("App"), not the lifetime of the purchaser. The purchase of a Lifetime Premium account grants you access to premium features for as long as the App is actively maintained and supported by us. We reserve the right to discontinue the App or its premium services at any time without notice. In such events, or in the case of the App’s cessation, the Lifetime Premium Purchase does not guarantee continued access to premium features indefinitely. Refunds for Lifetime Premium Purchases will not be provided in the event of the App’s discontinuation. By opting for a Lifetime Premium Purchase, you acknowledge and agree to these terms, understanding that "lifetime" is contingent upon the lifespan of the App’s active maintenance and availability as determined by Chess Prep Pro.

8. Acknowledgment of Potential App Limitations

While we strive to provide a seamless and error-free experience with Chess Prep Pro, we acknowledge that the app, like any software, may contain bugs or experience unexpected issues that could affect its performance and functionality. Despite our best efforts to maintain and update the app, there may be instances where these bugs or issues cause disruptions, including potential damage to a user’s progress, loss of data, or other inconveniences. We encourage users to regularly back up their data and progress to mitigate potential losses. Please understand that by using Chess Prep Pro, you acknowledge and accept the risk that app malfunctions may occur, and agree that Chess Prep Pro will not be held liable for any loss of data, progress, or any other damages or inconveniences resulting from such issues. We appreciate your understanding and continued support, and we commit to promptly addressing any problems to improve the app continually.

9. Prohibition of Unauthorized Access to Premium Features

Access to premium features of Chess Prep Pro is strictly reserved for users who have legitimately acquired them through official purchase channels, including direct purchases within the app facilitated by the Google Play Store or Apple App Store. It is expressly forbidden to attempt to gain access to premium features by any unauthorized means. This includes, but is not limited to, creating multiple accounts to exploit trial periods (if offered), sharing accounts among multiple users to bypass purchase requirements, or engaging in any form of hacking or unauthorized modification of the app to unlock premium features. Such actions are considered a violation of these terms and conditions and may result in immediate termination of your account, without prejudice to any legal actions Chess Prep Pro may take to protect its intellectual property and rights. We monitor account activity for signs of abuse and reserve the right to enforce these terms to ensure fairness and maintain the quality of our service for all legitimate users.

10. Updates to Terms and Conditions

Please be aware that the Terms and Conditions governing the use of Chess Prep Pro, including all related services and features, are subject to change at our discretion without prior notice. These changes may reflect updates to our services, legal requirements, or adjustments to our operational policies. We encourage all users to review the Terms and Conditions periodically for any updates or changes. The most current version of these terms will always be available within the app and or our website. Your continued use of Chess Prep Pro after any changes to the Terms and Conditions signifies your acceptance of those changes. It is your responsibility to stay informed about, and comply with, the most up-to-date terms governing your use of Chess Prep Pro.

By use of our corporate name; orBy use of the uniform resource locator being linked to; orBy use of any other description of our App being linked to that makes sense within the context and format of content on the linking party’s site.No use of Chess Prep Pro’s logo or other artwork will be allowed for linking absent a trademark license agreement.

12. Prohibited Distribution of software:

The Chess Prep Pro application ("App") is made available to users exclusively through chesspreppro.com, the Google Play Store, and the Apple App Store. Users are strictly prohibited from distributing, sharing, repackaging, or transmitting the App in any form, including but not limited to APK (Android Application Package) files, IPA, or any other file format, through any distribution channels other than the official sources mentioned. Unauthorized sharing of the App undermines the security of our software, violates intellectual property rights, and is against our company policy. Any user found distributing the App through non-official channels may face account suspension or termination, and legal action may be taken against them to the fullest extent permitted by law.

13. Advertising and Personalization

Chess Prep Pro utilizes Google’s AdMob advertising service to display advertisements within the app. These ads are personalized to enhance your experience by showing content relevant to your interests. Personalization is based on your app usage, browsing history, and other factors that Google’s AdMob considers relevant. For our users within the European Union or under the scope of the General Data Protection Regulation (GDPR) or other relevant laws, you have the right to opt out of personalized advertising. Opting out means you will still see ads, but they may be less relevant to you. To adjust your ad preferences or opt out of personalized advertising, please visit the "privacy" section of the settings page within the app. We are committed to respecting your privacy and complying with relevant data protection laws, ensuring you have control over your personal information and advertising preferences.

14. Refund Policy and Process

If you are not satisfied with your purchase within Chess Prep Pro, please note that refunds are processed directly through the platform from which you made the purchase (Google Play Store or Apple App Store) and not through us, the developers of Chess Prep Pro. Each platform has its own policy and procedure for requesting refunds: For purchases made through the Google Play Store: You can request a refund through your Google Play account. Go to "Order History," find the transaction you want to return, and click on "Request a refund" or "Report a problem" and follow the on-screen instructions. Google Play typically offers a refund for apps within 48 hours of purchase, but exceptions can apply. For more detailed information, please refer to Google Play’s support documentation. For purchases made through the Apple App Store: Refund requests need to be submitted through your Apple ID account’s purchase history. We shall not be hold responsible for any content that appears on the App. You agree to protect and defend us against all claims that is rising on our App. No link(s) should appear on any Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

21. Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our App. You approve to immediately remove all links to our App upon request. We also reserve the right to amen these terms and conditions and it’s linking policy at any time. By continuously linking to our App, you agree to be bound to and follow these linking terms and conditions.

If you find any link on our App that is offensive for any reason, you are free to contact and inform us any moment.
